\u00cen anul 2024 numero\u0219i pensionari militari s-au trezit cu pensiile diminuate prin aplicarea unui impozit progresiv de 10%, 15% sau chiar 20%. Curtea Constitu\u021bional\u0103 a Rom\u00e2niei a declarat aceast\u0103 practic\u0103 neconstitu\u021bional\u0103.<\/p>\n

Cu toate acestea, sumele re\u021binute ilegal nu sunt restituite automat de Casa de Pensii Sectorial\u0103. \u00cen majoritatea cazurilor este nevoie de interven\u021bia instan\u021bei de judecat\u0103 pentru recuperarea lor.<\/p>\n

Recent, am ob\u021binut o hot\u0103r\u00e2re judec\u0103toreasc\u0103 definitiv\u0103 \u0219i executorie prin care Tribunalul Harghita a obligat Casa de Pensii Sectorial\u0103:
\n1\ufe0f\u20e3 s\u0103 recalculeze impozitul conform art. 101 alin. 2 lit. b din Codul fiscal;
\n2\ufe0f\u20e3 s\u0103 restituie banii re\u021binu\u021bi ilegal;
\n3\ufe0f\u20e3 s\u0103 pl\u0103teasc\u0103 dob\u00e2nzi \u0219i actualiz\u0103ri cu rata infla\u021biei pentru sumele re\u021binute.<\/p>\n

Aceast\u0103 hot\u0103r\u00e2re confirm\u0103 faptul c\u0103 este posibil\u0103 \u0219i justificat\u0103 recuperarea impozitului pe pensia militar\u0103, atunci c\u00e2nd sumele au fost re\u021binute cu \u00eenc\u0103lcarea Constitu\u021biei \u0219i a legisla\u021biei fiscale.<\/p>\n
